    Terms of Service, Rules, & Announcements

    Terms of Service Boords.com: Part 1
    Introduction
    Registration to all of the forums at Boords.com is free! However you must you abide by the rules and policies detailed in this document. Some principles for all the forums at Boords.com are that users should use: 1. Common Courtesy, 2. Common Decency, 3. Common Sense, 4. Should not break any laws or perform irresponsible behavior, and 5. That no one, and no entity, should ever sue or be litigious against Boords.com and its owners, operators, workers, or volunteers to the extent that such a statement can be enforced.

    We try to have a hands-off approach at Boords.com, and all its forums, to promote free speech and the free exchange of ideas. However, we reserve the right to moderate and censor the messages and posts when deemed necessary for whatever reason.
    Please be cautious about any information that you receive from Boords.com or any of its message boards, or forums. Remember, that it is your responsibility to check facts and seek out professional help or advice when needed. We cannot guarantee the accuracy of our posters. Indeed, you should know that the Internet has been used to disseminate untrue information.
    By using any forum located at Boords.com you agree to all of the following:

    You agree that if anything on any of the forums bothers you to stop using the forum or forums immediately, and not to view Boords.com or any of its forums from then on except to report the problem. You agree not to sue the owners, operators, workers, or volunteers associated with Boords.com for any reason to the fullest extent of the law; although this is a general statement, it should be understandable by everyone. This policy is to help us avoid all frivolous and non-meritorious actions, and to avoid all litigation. We do not have the resources to run everything perfectly, so we prefer that you don’t participate if there is a problem.

    You agree that you will indemnify and hold harmless Boords.com, its owners, workers, employees, agents, or volunteers, with respect to any claim based upon the appearance and/or transmission of your post(s) or message(s). In the event of any complaint or legal action arising from anything posted by you, Boords.com, its owners, workers, employees, agents, or volunteers reserve the right to reveal your identity and any other information we may know about you.
    Agreement not to Sue
    To the full extent not prohibited by law, Boords.com and its owners, operators, workers, or volunteers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, revenue, good will, use, data, electronically transferred information, loss of reputation, or loss of income, however caused and regardless of the theory of liability, arising out of or related to the use of this website or the inability to use this website.

    Boords.com and its owners, operators, workers, or volunteers shall not be responsible or liable for any unauthorized access or conduct of any third party on this website, or who posts on this website, or who hacks into this website.
    You agree to hold Boords.com and its owners, operators, workers, or volunteers harmless from, and you covenant not to sue Boords.com and its owners, operators, workers, or volunteers for any claims based on this website. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
    Arbitration
    If you have a dispute against Boords.com, you agree to binding arbitration. Each party acknowledges that the arbitration process, and in particular, the Arbitrator's award, is binding and conclusive upon all parties and not subject to appeal or review by any judicial or administrative process. Each party agrees that use of any forum at Boords.com constitutes an irrevocable consent to having any such action resolved entirely through arbitration.

    The Arbitrator shall hear and determine the controversy upon the evidence submitted and shall have the ultimate responsibility to determine the relevancy and admissibility of the evidence. The parties agree that hearings shall be conducted by the Arbitrator in any manner which permits a fair presentation of each party's position. You agree that any dispute arising from using Boords.com shall be submitted to binding and confidential arbitration at a location chosen by the owner or owners of Boords.com. Arbitration shall be conducted under the rules of the American Arbitration Association. To the fullest extent permitted by law no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class action proceedings or otherwise. Similarly, if any legal action is taken against Boords.com, its owners, operators, workers, or volunteers, no such action shall be joined with any other party in a class action proceeding or otherwise.
    Jurisdiction
    You agree that that if you start any legal action or arbitration against Boords.com, or its owners, operators, workers, or volunteers that the state of Florida shall have personal jurisdiction, and any type of jurisdiction, over the case and you agree only to sue in the state of Florida, and specifically in Highlands County Florida, and the city of Sebring, FL, if possible. You agree that these are the only acceptable jurisdictions, and only the State of Florida will have jurisdiction over the lawsuit, and only in Highlands County, Florida, and only in the city of Sebring, FL, if possible.
    E-mails
    E-mails explained
    You may be e-mailed from Boords.com if you have joined any of the forums. E-mails will be mostly to inform you of responses to your posts or threads. But at times, e-mails will be used for other administrative purposes, reminders, or rarely for new services. You may get a periodic reminder email just so you don’t forget about the forum you joined. You may get e-mails if Boords.com goes down or has to be moved to a new location.

    Your e-mail address may be visible if the allows users to message each other or e-mail each other function is turned on, or may be visible through Facebook or any other social networking system you use.
    Posting Issues

    You take all responsibility for what you post. Do not post inflammatory or repeated commercial posts. Do not post negatively against the moderators. Do not make personal attacks, be rude, or be abusive. Do not attack individuals. Do not do name calling. Do not harass others. Do not use profanity. Do not do identity theft, do not stalk any other user, or publish personal, or confidential, information about others without permission. Cite sources if necessary to establish fact from fiction. We reserve the right to challenge, change, or delete anything without notice.

    We reserve the right to moderate and censor Boords.com, or any of its forums, when deemed necessary for whatever reason.
    If inappropriate posts occur, or any of the rules are not followed, depending on each individual case, you will either be given a warning and/or banned. You do not have to be given a warning. All the forums at Boords.com are a privilege and not a right. To keep the forum civil and informative these actions are sometimes necessary.

    Users should post in a way which is consistent with "normal writing." That is users should not post using an excessive numbers of emoticons or colored text. Similarly users should not SHOUT or use excessive punctuation. Users should use an appropriate, descriptive title when posting a new topic.

    Posting Guidelines & User Behavior
    You agree not to collect, use or disclose data, including personal information, about other users without their consent or for unlawful purposes or in violation of applicable law or regulations.

    You agree not to request, solicit or otherwise obtain access to usernames, passwords or other authentication credentials from any member of Boords.com, or any of its forums.

    You agree not to post any content that constitutes pornography, contains nudity, or is adult in nature, or that contains child pornography, or that depicts or contains rape, extreme violence, murder, bestiality, incest, or other similar content. In addition, do not link to any of these things.

    You agree to not to data mine this Boords.com or any of its forums. You agree not to use automated means, including spiders, robots, crawlers, data-mining tools, or the like to download data Boords.com or any of its forums. This does not include or preclude Internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org) that comply with our robots.txt file, or "well-behaved" web services/RSS/Atom clients. We reserve the right to define what we mean by "well-behaved.”

    You agree not to post irrelevant content, repeatedly post the same or similar content, or otherwise impose an unreasonable or disproportionately large load on Boords.com, its forums, or its server.

    You agree not to attempt to gain unauthorized access to our system or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of Boords.com or any of its forums.
    You agree not to use this Network as a generic file hosting service, or to take any action to distort any of the polls or rating features. You agree not to invoke or use any code to disrupt, diminish, or impair Boords.com or any of its forums.
    Please keep the message forums as appropriate as possible for all audiences. Self-promotion and spam are generally prohibited. Automatic posing via scripts or posting bombs is prohibited.
